Terms of Use and Sale
These terms govern professional and Athlete use of Hardi, including accounts, subscriptions, taxes, Energy, workspaces, content, sharing, AI features, and data processing.
Version hardi-1.3.1 · Effective date: 19 October 2026
1. Purpose
These Terms govern the shared Hardi account and its Training and Programming spaces. Hardi is the trading name of the service operated by POWERSPOT, a French SARL with share capital of EUR 1,000, registered office at 38 rue des Vallées, 92700 Colombes, France, registered with the Nanterre RCS under SIREN 878 966 639, VAT number FR34 878 966 639. The Legal Notice gives its contact details and those of the hosting provider.
Training and free personal features may be used in a personal capacity. Paid Programming offers, Team seats and Energy may be ordered by a business customer or an adult consumer. The buyer confirms being at least 18 and, for a business purchase, having authority to bind that customer. B2B clauses and the Data Processing Agreement apply only to business relationships; Team membership does not make a member its purchaser.
An independent personal account is available from age 16. At 16 or 17, a parent or legal guardian must authorize its creation beforehand. No B2B clause deprives a user acting in a personal capacity of mandatory rights, including liability rules, statutory warranties where applicable, and jurisdiction rules. A free personal account does not waive those rights.
2. Access to the service
The same account can access Training and Programming on hardi.app, subject to the rights of its plan and any Team workspace. Moving between these spaces does not create another identity or transfer private Team permissions.
Selected features require an account, an active paid plan, available Energy, or workspace permissions. Public demos and sharing links may be available without signing in under their own usage limits.
3. User account
You must provide accurate account information, safeguard your credentials, and notify us if your account is used without authorization. Your public username and profile choices are your responsibility.
You are responsible for actions from your account unless a failure attributable to POWERSPOT caused them. Deleting the common account affects both Training and Programming and may require Team ownership or dissolution actions first.
An autonomous member must meet the age and authorization rules in Section 1. A person under 16 may be represented only through an authorized coach, responsible organization, parent, or guardian, with minimized data and preferably an alias.
4. Google sign-in
You may authenticate with your email or Hardi username and password, or with Google where available. An @ prefix or different letter case in the username does not identify a different account.
Google sign-in supplies basic information, including your email and, where available, first and last names to prefill registration. Your Google photo is not used as your Hardi avatar. An account created only with Google has no Hardi password until its holder adds one in Settings > Account with a recently authenticated session. The Hardi form never asks for your Google password. Google remains subject to its own terms and privacy policy.
5. Plans, subscriptions, and Energy
Hardi may offer free or paid plans, usage limits, a weekly Energy allowance, and Extra Energy purchases. Available limits, prices, and features are displayed in the application at the time of use or purchase.
Pro and Team include an unlimited number of saved workouts, calendars, scheduled workouts, and week templates in the covered workspace while the plan is active. Unlimited means that these categories have no total numerical plan quota; it does not mean unlimited AI usage, Energy, Team seats, file sizes, or processing capacity.
Technical safeguards still apply, including request and creation rates, simultaneous operations, batch sizes, and the number of items that can be placed in one day or template. These safeguards protect service availability and regulate the pace and size of operations; they do not introduce a hidden total plan quota for the unlimited categories. A large amount of legitimate coaching content is not, by itself, abusive use. Abusive automation, attempts to bypass safeguards, and activity that disrupts the service may be limited or suspended under these terms.
If you move to a plan with numerical quotas, its limits apply when the change takes effect. Existing content is not automatically deleted solely because it exceeds those quotas. Actions that increase a resource beyond its applicable quota, such as creation, copying, or restoration, may be blocked until you free up capacity or change plans. Existing content remains accessible within the features and permissions of the new plan. The separate Team cancellation, archive, and dissolution rules below continue to apply.
Included Energy refreshes weekly according to the period shown in the application; unused included Energy does not roll over. Included Energy is spent before purchased Extra Energy. Extra Energy does not disappear at the weekly refresh and remains attached to the purchasing account or Team workspace while it exists.
Energy is a contractual unit for AI features, not money or a stored-value product. It cannot be transferred, exchanged for cash, or moved between personal and Team balances. Fixed-cost actions show their Energy cost before launch. Hardi AI tasks use variable Energy based on measured usage, including the selected model and work performed; the final debit is determined after execution, rather than promised as a fixed price in advance.
An Energy reservation can temporarily reduce the available balance while a task runs. On settlement, unused reserved Energy is released and the final debit is recorded. A failed or interrupted task is not necessarily free if billable work has already been performed; usage that the service identifies as non-billable is absorbed or credited back. Applicable rates may change prospectively.
6. Payment and billing
Subscription, Team seat and Energy prices are displayed in EUR including tax for the selected billing country. Catalogue tax-exclusive bases are unchanged. Stripe confirms the total before payment using the customer's address and tax status, including a valid VAT ID and any exemption. The customer is responsible for accurate billing details. Local currency may be offered where available, with EUR remaining an option. Stripe's exchange rate includes a 2–4% conversion fee shown before confirmation. Existing subscriptions do not automatically change currency.
Preset Energy packs retain their Energy quantity and tax-exclusive base. For a custom top-up, the entered EUR amount is a tax-inclusive budget; Energy is calculated from Stripe's confirmed net payment, at 400 Energy per EUR before tax. Changing the billing address or tax status at payment may change the custom pack's final Energy quantity.
Payments, payment methods, invoices, automatic tax calculation, and technical refunds are managed by our payment provider. Hardi does not store full card numbers. Monthly subscriptions are charged in advance and renew automatically for successive monthly periods until cancelled.
B2B invoices are due immediately through our payment provider unless an invoice expressly states another due date. No discount is granted for early payment. Any overdue amount automatically bears late-payment interest, without prior reminder, at the European Central Bank refinancing rate applicable to the relevant period plus ten percentage points, together with the statutory fixed recovery charge of EUR 40 per overdue invoice. Additional documented recovery costs may be claimed when they exceed that fixed charge.
Cancellation through the billing portal takes effect at the end of the paid period and is distinct from a consumer's withdrawal right. Except for mandatory rights or Hardi's express agreement after a duplicate charge or proven technical error, paid periods, unused seats and Energy are not refundable solely at the buyer's convenience.
A consumer has fourteen days from contract conclusion to withdraw without giving a reason, using Settings > Plan > Withdraw from a purchase or an unambiguous notice to contact@hardi.app. A downloadable acknowledgment is provided. Requesting immediate activation does not waive withdrawal rights. Where service starts at the consumer's express request, only a proportionate amount for service actually supplied may be due under applicable law. Any refund due is made within fourteen days of the notice, using the original payment method, without additional fees.
Optional model form: To POWERSPOT, 38 rue des Vallées, 92700 Colombes, France, contact@hardi.app. I withdraw from the contract for [plan or top-up], ordered on [date], reference [reference], name [name], address [address], date [date]. Signature only for a paper notice.
Consumers retain statutory guarantees for digital content and services, including conformity throughout the continuous supply period and correction without charge. They may request conformity and, where statutory conditions are met, a price reduction or contract termination. These rights supplement withdrawal rights and are not limited by B2B exclusions.
7. Team workspaces
A Team has a shared programming workspace and a separate public profile. Its content belongs to that workspace and is published under its identity, with the author identified. Athletes’ results, scores and exercise records remain personal. An account may belong to several Teams, within the limit shown by the service.
Personal Free, Plus and Pro plans are independent from Team subscriptions. Joining, leaving or owning a Team does not change a personal plan. Features and Energy included in the Team subscription apply only in its workspace. Team Energy is pooled according to purchased seats and cannot be transferred to a personal balance.
Creating a Team requires a paid subscription. Activation follows payment at the tax-inclusive seat price displayed and confirmed before payment, with a minimum of two and a maximum of twenty seats. The owner chooses the seat quantity; members and pending invitations occupy this capacity. Added seats become available only after the corresponding invoice is paid. A reduction takes effect at the next renewal, subject to sufficient capacity for members and invitations, and restricts new invitations as soon as it is scheduled.
The owner manages the subscription. After recent reauthentication, they may request an ownership transfer to another active member, either an Admin or a Coach. The recipient must explicitly accept from their account, at which point the former owner becomes an Admin. The request expires after seven days. Only one request may be pending per Team; sending a new request cancels the previous one.
The new owner takes over management of the team and its billing. The existing subscription, payment method and billing contact are retained, as explained before the request and acceptance, and can be changed in the Stripe portal. The people carrying out the transfer must have the necessary authority and permissions for this management and the continued use of the payment method. Transferring the Hardi role does not, by itself, change the contractual customer’s identity or obligations already incurred. A change of contractual customer, in particular between two businesses, must be agreed separately with POWERSPOT; changing invoice details does not, by itself, assign the contract.
Cancellation takes effect at the paid-period end. At that point, or immediately after a failed renewal payment, Team programming becomes read-only with no grace period. During the thirty days following this loss of access, previously shared programs remain accessible and athletes may enter or correct their own results in those programs. Coaches cannot create or edit results for other people. After thirty days, workouts and calendars are retained but become unavailable, including to Team members, until reactivation; their public links no longer allow access. The Team profile remains visible according to its publication setting, and previously acquired personal history is retained under the applicable rules. Successful payment or subscription reactivation restores the corresponding access rights.
Cancelling the subscription does not delete the Team. Permanent dissolution is a separate owner action available after the subscription ends and pending payments are settled. An unresolved seat change, payment or financial reconciliation, an ongoing Energy operation or an outstanding Energy balance must be resolved before dissolution.
Permanent dissolution is a separate, irreversible, recently authenticated owner action. It deletes the Team's shared Library, Schedule, branding, public links, Team leaderboards, guest results, and Team-only content; it does not delete members' personal spaces or profiles. Approved minimal authenticated-Athlete history may remain privately without Team context. Remaining Team Extra Energy is forfeited and recorded, and legally required minimized financial and deletion evidence may be retained.
8. User content
You retain your rights in the workouts, profiles, performances and other content you submit. You grant POWERSPOT a non-exclusive, royalty-free licence, valid in the territories needed to provide the service, to host, reproduce, display, calculate, technically convert and transmit that content only according to the features used, your instructions and chosen visibility. It lasts for as long as the content must be retained for those purposes, subject to legal obligations. It does not authorize us to resell your content or use it for third-party advertising.
Assigning content to a Team workspace does not, by itself, transfer intellectual-property ownership. By voluntarily contributing to its shared workspace, you authorize, to the extent of your own rights, permitted members to use and edit your contributions in that workspace and share them under their permissions and publication settings for the purposes of that collaboration. These permissions cover retention and continued use of existing contributions after you leave, subject to any applicable agreement with the rights holder and mandatory rights. They grant no access or additional rights to your personal work outside the Team, and do not authorize independent exploitation beyond the sharing and copies permitted by the service.
Performances are self-reported and are not certified by Hardi. Records, estimates and comparisons depend on the protocol, entered data and available sample. You must correct or remove entries you know to be inaccurate. Catalogue sheets and videos are informational resources, not certification of the movement performed.
You confirm that you hold the rights and permissions needed for content and other people's data you publish. Shared-space contributions, authorized copies and personal result snapshots may remain under the retention and deletion rules described in the Privacy Policy. POWERSPOT may restrict unlawful content or content contrary to these Terms under the reporting and appeal procedure.
9. AI-assisted features
Hardi AI features may generate, transform, analyze, search, or help plan workout content. Their outputs and automated checks may contain errors, omissions, approximations, or recommendations unsuitable for a given audience.
You remain responsible for reviewing, adapting, and validating all assisted content before using, publishing, or sending it to athletes or members. Hardi does not replace the professional judgment of a qualified coach, healthcare professional, or sports safety expert.
10. Public shares and exports
Hardi can display public athlete profiles, the records their owners select, public workouts, calendars, result pages, exports, and projection views. Anyone with access to a public page or link can view and re-share the visible content while it remains available.
Section-visibility settings, account blocking, Team permissions, and calendar passwords restrict access as described in the product; they do not recall screenshots, downloaded files, or copies already shared elsewhere. Private coach notes are not included in public surfaces.
Check the information before publishing or exporting it, and do not share another person's personal data without an appropriate basis or authorization.
11. Prohibited uses
You agree not to use Hardi to:
- Violate the law, third-party rights, or rules applicable to your activity.
- Attempt to access accounts, workspaces, data, APIs, or systems without authorization.
- Circumvent plan, Energy, seat, security, or billing limits.
- Disrupt the service, run excessive loads, abusive automation, or unauthorized tests.
- Share dangerous, hateful, fraudulent, unlawful, malicious, or privacy-infringing content.
- Use Hardi as the sole source for medical, nutritional, safety, or performance decisions without appropriate professional evaluation.
- Use Hardi as a medical record or store health, medical, biometric, or other sensitive data that is not strictly necessary for ordinary sports programming.
12. Hardi intellectual property
Hardi, its interface, design, texts, logos, trademarks, components, workflows, code, data models, and product elements are protected by applicable intellectual property rights.
Nothing transfers ownership of Hardi to you. You receive only a limited, personal or professional, non-exclusive, non-transferable, and revocable right to use the service under these terms.
Third-party names and trademarks
CrossFit and HYROX, and their associated names and logos, are trademarks of their respective owners. POWERSPOT and Hardi do not own those marks and are not affiliated with, endorsed by, sponsored by, or officially connected to their owners.
References to CrossFit or HYROX describe workout disciplines or user-selected programming contexts only. They do not grant a right to use third-party logos or imply certification, affiliation, or approval.
13. Personal data
Personal data processing is described in the Hardi Privacy Policy at https://hardi.app/privacy. POWERSPOT is controller for account, billing, support, security, and service-operation data. For athlete, employee, or member data entered or imported by a professional customer, the customer is controller and POWERSPOT is processor under the following Data Processing Agreement.
Appendix A — Data Processing Agreement: scope and instructions
This Data Processing Agreement (DPA) is incorporated into these terms and applies whenever POWERSPOT processes personal data on behalf of the professional customer. Its subject matter is the hosting and operation of Hardi; its duration is the service relationship plus the deletion or return period; and its purpose is to create, organize, analyze, schedule, and share sports programming and related athlete information on the customer's documented instructions.
Data subjects may include the customer's athletes, staff, contractors, and workspace members. Data may include identity and contact details, avatars, sports categories, workouts, schedules, results, scores, notes, and technical identifiers. The customer must not instruct Hardi to process medical records or unnecessary special-category data.
The customer determines the lawful purposes and legal bases, gives required notices, obtains any required authorizations, respects data-minimization rules, handles data-subject requests as controller, and ensures its instructions comply with law. POWERSPOT processes the data only on documented instructions, including those expressed through normal product use, unless EU or Member State law requires otherwise.
If EU or Member State law requires processing outside those instructions, POWERSPOT will inform the customer before processing unless that law prohibits notice for important public-interest reasons. POWERSPOT will immediately inform the customer if it considers an instruction to infringe applicable data-protection law.
Appendix A — Confidentiality, security, and incidents
POWERSPOT limits access to authorized persons bound by confidentiality and maintains measures appropriate to the risk, including access controls, tenant and workspace authorization, encryption in transit, managed hosting and database controls, logging, backups, vulnerability and dependency maintenance, and incident procedures.
POWERSPOT will notify the customer without undue delay after becoming aware of a personal-data breach affecting customer-controlled data and will provide reasonably available information for the customer's legal assessment and notification duties. The customer remains responsible for its user permissions, exports, public links, devices, credentials, and the content it chooses to enter.
Appendix A — Subprocessors, transfers, assistance, and end of service
The customer generally authorizes the categories of subprocessors needed to provide Hardi, including managed authentication, database, storage, hosting, delivery, technical-log, and specialized AI services. Payment and optional sign-in providers process data for POWERSPOT's controller activities and do not ordinarily receive the customer's athlete dataset.
POWERSPOT remains responsible for imposing equivalent data-protection obligations on subprocessors. It will give the customer reasonable prior written notice, by email or in-product notice, of any intended addition or replacement, with enough information and time to raise a substantiated data-protection objection before the change takes effect. If the parties cannot resolve the objection, the customer may stop the affected feature or terminate the affected service. Urgent security changes may be notified as soon as reasonably possible. Where data is transferred outside the EEA, POWERSPOT relies on an adequacy decision, standard contractual clauses, or another valid transfer mechanism.
Taking into account the nature of the processing, POWERSPOT will provide reasonable assistance with data-subject requests, security, breach assessments, impact assessments, and regulator consultations. At the customer's choice when the service ends, POWERSPOT will return or delete customer-controlled personal data and delete existing copies, subject to the documented retention periods in the Privacy Policy, mandatory legal retention, and isolated rolling backups that are not restored for ordinary use.
POWERSPOT will make available the information needed to demonstrate compliance with this DPA and allow and contribute to reasonable audits, including inspections, by the customer or its mandated auditor. Audits require reasonable prior notice and must protect confidentiality, security, other customers, and service continuity; the customer bears reasonable costs beyond standard compliance assistance unless the audit reveals a material breach by POWERSPOT.
14. Availability and maintenance
We make reasonable efforts to keep Hardi available, performant, and secure. The service may nevertheless be interrupted or degraded for maintenance, incidents, force majeure, third-party provider intervention, infrastructure changes, or network issues.
Hardi is provided as is to the extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or perfectly suited to every use.
Neither party is liable for delay caused by an event beyond its reasonable control, provided it informs the other party where practicable and takes reasonable steps to limit the effects.
15. Liability
Hardi does not prescribe user-created workouts and does not systematically verify their content or results. Each author or participant must exercise the judgment and care described in the Sports Disclaimer. This does not excuse POWERSPOT's own breaches.
Only in its relationship with a business customer, and to the extent permitted by law, POWERSPOT is not liable for indirect losses such as lost revenue or opportunities. For a paid service, its aggregate contractual liability for claims over twelve months is capped at the amounts excluding tax that customer paid for the relevant service during the twelve months preceding the event giving rise to the claim. This cap does not apply to a free service. These limitations do not apply to users acting in a personal capacity, fraud, intentional misconduct, gross negligence, a breach of an essential obligation making the limitation unenforceable, bodily injury attributable to POWERSPOT, or liability that cannot lawfully be limited, including under the GDPR.
For users acting in a personal capacity, liability follows ordinary law and applicable mandatory protections. Nothing removes a legally recognized right to compensation or a statutory warranty applicable to a digital service. You may be liable for harm caused by your own fault, unlawful content or misuse of the service.
16. Suspension and termination
You may stop using Hardi or delete your account using the options available in the application. Deletion may permanently remove associated content and data.
We may suspend or terminate access to all or part of the service in case of terms violation, security risk, fraud, unpaid fees, abuse, legal request, or behavior that endangers the service or other users.
Where reasonably possible, we will give notice and an opportunity to remedy before terminating for breach. Immediate restriction remains possible for urgent security, legal, payment-fraud, or third-party-risk reasons.
17. Changes to the terms
The displayed version and effective date identify the applicable Terms. Material adverse contractual changes are announced before taking effect, normally at least thirty days in advance, unless a legal obligation or security emergency justifies a shorter period. You may stop using the service and cancel a subscription before an affected renewal.
A price change does not apply retrospectively to an already paid period and takes effect no earlier than a later billing period after notice. Where a change requires renewed acceptance, Hardi asks for an explicit action before continuing; browsing alone does not replace that acceptance. A new optional purpose requiring your consent is handled separately from acceptance of the Terms.
18. Governing law
These terms are governed by French law. The parties will first attempt in good faith to resolve a dispute after written notice. For disputes between parties having merchant status, the Economic Activities Court of Nanterre (Tribunal des activités économiques de Nanterre) has exclusive jurisdiction; otherwise, jurisdiction follows mandatory procedural rules.
19. Contact
Contractual questions, complaints, reports and contact for authorities: contact@hardi.app, +33 1 85 09 30 94, or POWERSPOT, 38 rue des Vallées, 92700 Colombes, France. You may write in French or English.
To report unlawful content, give its precise location or URL, reasons for the report, relevant evidence and contact details for a reply, and confirm that the information is accurate and complete to the best of your knowledge. Report a profile and Report a problem features supplement this channel; an error in an exercise sheet is not necessarily unlawful content.
We assess reports diligently, objectively and proportionately. A restriction may use an automated check, particularly for images; reasons and appeal options are communicated to the affected member where law and security permit. Human review may be requested through the available in-product appeal or by email, including within six months of the decision. Judicial and other statutory remedies remain available. A paid subscription does not by itself give an account priority treatment.
